“NAME YOUR DREAM ASSIGNMENT” CONTEST

OFFICIAL RULES
NO PURCHASE NECESSARY

WHAT TO DO:  Register online and tell us what would be your “Dream Assignment”  include a weblink referencing  your photography work, as set forth herein these Official Rules, for the opportunity to win a trip to and carry out your “Dream Assignment” destination in the “Name Your Dream Assignment” Contest (the “Promotion”).  Open only to residents of the 50 United States and Washington, DC, who are at least 18 years of age and have reached the age of majority in their home state, by March 3, 2009.  Void outside of the 50 Unites States and Washington, DC, and where prohibited, taxed, or restricted by law.

  1. HOW TO ENTER:  Beginning 12:00:01 AM Eastern Standard Time (“EST”) on 3/3/09 through 11:59:59 pm EST on 4/3/09, visit www.nameyourdreamassignment.com (the “Web Site”) and follow the online entry instructions, which includes providing accurate contact information as well as uploading each of the following:

    1. Short Summary: Original short (240 character maximum) summary describing what constitutes your “Dream Assignment”.
    2. Detailed Statement:  Original statement elaborating on the Short Summary, which further details your “Dream Assignment”.
    3. Avatar:  An original graphic which shall serve as a representation of you on the Web Site.  Avatars must only be 48 X 48 pixels, uploaded in the .jpg or .gif format, and comply with these Official Rules
    4. Portfolio:  Reference to a web site/url featuring entrant’s own original (for which entrant owns 100% copyright) photography work (“Photos”) with, if applicable, a brief statement identifying with specificity which photographs are the entrant’s Photos.  Entrant must have permission to direct Sponsor to the referenced web site/url and only references to web sites/urls that do not have restrictions, registrations or payments necessary to enter and to view the entrant’s Photos will be considered eligible.  Any such references shall remain private to the Sponsor and Judges and the Photos will only be considered for the Finalist round of judging.

    Any Short Summary, Detailed Statement, Avatar, and Portfolio, including any Photo(s) referenced thereto, (collectively and individually, as applicable, the “entry” or “Submission”) must comply with these Official Rules and the Additional Requirements and Restrictions outlined below.  

    Limit three (3) entries per entrant.  If more than three (3) entries per entrant are received, only the first three of such entries received will be eligible, subject to verification.   A complete entry must include a Summary, Detailed Statement, Avatar and Portfolio.  Decisions of judges are final.

    Additional Requirements and Restrictions:  If any part of the Submission contains reference or depiction of any person(s) other than the entrant, entrant must receive prior written permission from other person(s) featured in the photo (or from parent/legal guardian of other person(s) if other person(s) featured are considered minors in their state of residence) for Sponsor to use their likenesses for publicity, including without limitation, on the Web Site, and such persons must agree to the use of their likeness without compensation.  Written copies of such permissions must be made available to Sponsor upon request.  IMPORTANT: If Entrant is selected as a potential Finalist, any other person(s) (or from parent/legal guardian if other person(s) featured are considered minors in their state of residence) appearing in any part of the Submission may be required to sign a publicity and liability release and waiver of liability, as detailed in Rule #5.   Do not include any personally identifiable information, such as your full name, address, phone number, e-mail or any other contact information) in either your Short Summary or Detailed Description.   ALL PARTS OF YOUR SUBMISSION MUST BE YOUR OWN ORIGINAL UNPUBLISHED WORK AND CANNOT CONTAIN, INCORPORATE OR REFERENCE ANYTHING THAT IS OWNED BY ANY THIRD PARTY OR ENTITY OR WOULD REQUIRE THE CONSENT OF ANY THIRD PARTY OR ENTITY IN ANY JURISDICTION.  Modifying, enhancing or altering a third party’s preexisting work does not qualify as entrant’s original creation. No part of the Submission may contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement.   Sponsor/judges reserve the right to disqualify any Submission that, in their sole discretion, refers, depicts or in any way reflects negatively upon the Sponsor, the promotion or any other person or entity or does not comply with these Official Rules.  Any Submission, which in the sole opinion of Sponsor, is deemed inappropriate (e.g., defamation, nudity, gratuitous violence, inappropriate language, etc.) will result in disqualification.

    Any “Dream Assignment” destination deemed unreasonable or impractical, in the sole discretion of the Sponsor, shall be ineligible for the Grand Prize.

  2. ONLINE VOTING:   Beginning 12:00:01 AM EST on 3/3/09 through 11:59:59 pm EST on 4/3/09, all eligible entrants’ Short Summaries and Detailed Statements will be displayed on the Web Site  and visitors thereto will have the opportunity to select their favorite entries by following the online instructions.  Online voters will be allowed to vote for as many entries, which they believe showcase originality and creativity, as desired, but shall be limited to one (1) vote for each particular entry.  At the conclusion of the voting period, the twenty (20) entries with the most eligible votes will be deemed the “Finalists,” pending verification of eligibility and compliance with these Official Rules.  In the event of a tie, tied entries will be judged by Sponsor in accordance with the criteria outlined in Rule #3.  Any use of robotic, automatic, programmed or the like methods of participation will void all such entries by such methods.  Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the individual fails to comply with any terms in these Official Rules or posted to the Web Site.  Vote tabulations will be accomplished by Sponsor and will be maintained on a confidential basis and will not be released.

    REMEMBER -- ONLINE VOTING STARTS AT THE SAME TIME AS REGISTRATION OPENS, SO ENTER EARLY FOR A FULL OPPORTUNITY TO EARN VOTES THROUGHOUT THE ONLINE VOTING PERIOD.  

  3. JUDGING:  The twenty (20) Finalists determined via online voting will be judged by a panel appointed by Sponsor, which shall include Sponsor’s and its promotions agency’s representatives as well as photography experts (the “Panel”), to determine the top three (3) Submissions.  The top rated Finalist’s Submission will be deemed the “Grand Prize Winner,” the next two (2) highest rated Finalist’s Submissions will each be deemed a “Runner Up”; each subject to verification of eligibility and compliance with these Official Rules.  The Panel will review each Finalist’s Short Summary, Detailed Statement, Avatar as well as his/her Portfolio and rate each Finalist’s Submission based on the following criteria:  (i) Originality and Creativity in describing one’s “Dream Assignment”– 70%; (ii) Skill Level and Experience as exhibited in the Detailed Statement and Portfolio – 30%.   In the event of a tie, tied Submissions will be rejudged based on the Originality and Creativity score (and then Skill Level and Experience, as necessary) to break such tie.  Potential winners will be contacted by via e-mail and/or telephone to request additional information required for prize fulfillment.  For each correspondence sent to potential winners, the required information must be received by Sponsor within seven (7) days, failure to comply within this time period may result in disqualification.  Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user’s internet service provider and/or e-mail client or for insufficient space in user’s e-mail account to receive e-mail.  Return of any e-mail as undeliverable may result in disqualification and an alternate will be selected.  

  4. PRIZES & APPROXIMATE RETAIL VALUES:  The Grand Prize Winner will win a $50,000 trip to carry out his/her “Dream Assignment” as stated in his/her Short Summary and Detailed Statement.  Grand Prize Winner will also receive one (1) Lenovo Thinkpad W700 laptop with Microsoft Vista (Approximate Retail Value (“ARV”) $5,000)  and one (1) digital video camera (ARV $150) (Total Grand Prize ARV $55,150).   The two (2) Runner Ups shall each receive one (1) Lenovo ThinkPad W700  laptop computer with Microsoft Windows Vista  (ARV  $5,000 each).    Total AVR for all Prizes is $65,150.   Trip details shall be further scheduled and developed by Grand Prize Winner and Sponsor based on the Short Summary, Detailed Statement and the $50,000 budget, but shall include a single room (double occupancy) standard hotel accommodation; round-trip coach air transportation from a major airport near Grand Prize Winner’s home (as determined by Sponsor in its sole discretion) to “Dream Assignment” destination, transportation between airport and hotel and shoot locations, and a daily stipend which can be used towards meals, taxes, gratutities and other expenses not specified herein.  Grand Prize Winner may bring one (1) travel companion, who must be at least 18 years of age and have reached the age of majority in his/her home state and who must sign and return to Sponsor a Release of Liability and, where legal, a Publicity Release, at least seven (7) days prior to travel or travel companion will not be permitted to accompany Grand Prize Winner on the trip.   Exact travel dates and arrangements subject to availability and any applicable blackout dates.  Other than as set forth herein, the Grand Prize Winner and travel companion are solely responsible for all other expenses not specifically set forth herein, including but not limited to any meals, additional transportation, souvenirs and other incidentals and items of a personal nature that Grand Prize winner does not cover with the daily stipend.  Grand Prize winner and travel companion must travel on same itinerary.  The actual retail value of the Grand Prize will depend on winner's point of departure/return.  Grand Prize trip must be taken on dates specified by Sponsor.  If winner cannot travel on dates specified by Sponsor, Grand Prize winner will forfeit prize and an alternate winner will be determined, time permitting.  Prizes consist of only those items specifically listed as part of the prize.  Limit one prize per person/household.  CONDITION TO GRAND PRIZE – PERSONAL SERVICES AGREEMENT:  As a condition of accepting the prize, Grand Prize Winner shall be required to negotiate in good faith and execute a Personal Services Agreement (“PSA”) with Sponsor or an alternate winner may be chosen. PSA will set forth winner’s responsibilities during the “Dream Assignment” Grand Prize trip. The PSA shall require, among other things, (1) winner to  manage and update an online blog of Sponsor’s choosing, featuring winner’s photographs from the “Dream Assignment” destination and including captions and technical details as appropriate; (2) winner to regularly profile the photography equipment, in particular the Lenovo ThinkPad W700, in the blog, pointing out useful features and attributes; and (3) that winner permit the use of his/her name, likenesses or identifying information and any blog content for promotional, publicity or advertising purposes in any media including without limitation print, TV, radio and online media (digital photography forums, other photographer’s blogs, viral, and social networks related to photography), without time or geographic limitations.  Grand Prize winner also must provide Sponsor with a royalty-free, perpetual license to use any digital photographs and/or other content posted to the blog in all media now known or hereafter invented for the advertising, publicity and promotion of Sponsor’s goods and services.   Notwithstanding any of the above, Sponsor’s sole obligation under the PSA is to award the winner with the Grand Prize outlined in these Official Rules. Sponsor will have no obligation to use the winner’s services, entry materials, or name or likeness in any manner whatsoever. In the event the winner fails to execute a PSA by a date specified by Sponsor, winner will forfeit the entire Grand Prize and an alternate winner may be selected from among the remaining Submissions, time permitting.  Sponsor reserves the right to not use any service under the PSA at the Sponsor’s sole discretion.

  5. GENERAL:  Employees, directors and officers of Lenovo, Microsoft and Capstrat and their respective contractors, as well as each of their immediate family members and/or those living in the same household of each are not eligible to participate.  Void outside the 50 United States and Washington DC, as well as where restricted, taxed or prohibited by law.  No substitution or transfer of any prize by winner is permitted.  All federal, state and local taxes are the sole responsibility of winner.  All federal, state and local laws and regulations apply.  Potential winners will be required to complete an Affidavit of Eligibility/ Release of Liability and, if legally permissible, a Publicity Release and certify that the Submission is entrant’s own original work and entrant holds all rights to the entry and all elements therein, and that entrant has complied with the Official Rules of the Promotion.  Entrant may also be required to obtain and submit a completed Publicity and Liability Release and Waiver of Liability for each additional person depicted in his/her entry, at Sponsor’s discretion.  All documents will be sent via overnight carrier and must be completed and returned within seven (7) days of attempted delivery of same.  Noncompliance with this time period or return of any notification as undeliverable may result in disqualification and an alternate may be determined.  Grand Prize winner and travel companion must possess required travel documents (e.g., valid photo ID) prior to departure.  Travel companion must also complete and return a Release of Liability and, if legal, a Publicity Release, within seven (7) days of attempted notification.  Return of any prize/prize notification as undeliverable will result in disqualification and alternate selection.  Sponsor reserves the right to substitute prize of equal or greater value.  All material submitted becomes property of Sponsor and will not be returned.  No correspondence will be acknowledged or entered into.  Sponsor/judges reserve the right to reproduce the submissions in full or edit and enhance the submissions at their discretion.  Sponsor is authorized to use winning Submissions as it sees fit, including usage in advertising and online without compensation.  No substitution or transfer of prize by winner permitted.  All taxes are the sole responsibility of winner.   By accepting prize, winner agrees to hold Sponsor, and its respective affiliates, subsidiaries, advertising, public relations and promotion agencies, and the directors, officers, employees and assigns of each, harmless against any and all claims and liability arising out of use of prize.  Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Promotion or use or redemption of any prize.  Acceptance of prize constitutes permission to the Sponsor and its agencies to use prize winner’s name and Submission for purposes of advertising and trade without further compensation, unless prohibited by law, including on a winners’ list.  Each entrant, including each winner, agrees to release, discharge and hold harmless Sponsor, and its respective affiliates, subsidiaries, advertising, public relations and promotion agencies, and the directors, officers, employees and assigns of each, harmless from and against any and all liability and damages.  By participating in this promotion, entrants, including the winners,  agree to be bound by the Official Rules and the decisions of the judges which are final.  In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control.  Sponsor is not responsible for any typographical or other error in the printing, the offering or the announcement of the prizes or in the administration of the contest and sweepstakes.  In no event will more than the stated number of prizes be awarded.

  6. THIRD PARTY RIGHTS:  Sponsor respects the rights of others.  The Web Site may contain materials of third parties and Sponsor may also transmit and store such third party materials, including materials created by entrants.  As a result, materials of third parties, not owned or controlled by Sponsor, are included in the Web Site or are stored or transmitted over Sponsor’s digital online communication systems.  To the best of Sponsor’s knowledge, these materials do not infringe the rights of others.  Upon receipt of proper notice of claimed infringement, Sponsor will respond expeditiously to resolve the claim between the notifying party and the alleged infringer who provided the materials in issue, including, where applicable, removing or disabling access to materials claimed to be infringing.  The proper party to whom you should address such notice is [email protected]

  7. PRIVACY:   Sponsor will be collecting personal data about entrants online in accordance with its privacy policy.   Please review Sponsor's privacy policy at http://www.lenovo.com/privacy/us/en.  By participating in the Promotion, you hereby agree to Sponsor's collection and usage of your personal information, and acknowledge that you have read and agreed to Sponsor's privacy policy.

NOTICE:  ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.  Sponsor and its respective affiliates, subsidiaries, advertising, public relations and promotion agencies, and the employees, directors and officers of each, are not responsible for faulty, incorrect or mistranscribed phone transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the Promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the Promotion.  Sponsor reserves the right to cancel or modify the Promotion if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the Promotion as determined by Sponsor/judging agency/administrator, in their sole discretion.  In the event of termination, a notice will be posted online and all eligible entries received prior to termination will be included in the judging.  Any damage made to any web site referenced herein will be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry.  Proof of submitting entries will not be deemed to be proof of receipt by Sponsor.  Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by en entrant’s Internet service provider and/or e-mail client or for insufficient space in entrant's e-mail account to receive e-mail.  In the event Sponsor is prevented from continuing with the Promotion or the integrity and/or feasibility of the Promotion is severely undermined by any event beyond Sponsor’s control, including but not limited to fire, flood, epidemic, earthquake, explosion, economic crisis, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, infection by computer virus, unauthorized intervention, technical failures or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Promotion without any further obligation.  If Sponsor, in its discretion, elects to abbreviate the Promotion as a result of a Force Majeure event, a notice will be posted on-line; Sponsor reserves the right, but not the obligation, to judge all valid and eligible entries received up to the time of such Force Majeure event in order to award the prize, providing a sufficient number of entries are received.
